Quincy Productions' Terms of Service

The following is a copy of our Terms of Service, namely the Listing Production Agreement, which is administered for each booking and is considered intellectual property. The unauthorized use or distribution of the following agreement is prohibited. Quincy Productions at any time may reserve the terms outlined herein by updating this document. By booking with Quincy Productions, you agree to be bound by the version of the document as administered and signed during the time of booking.
This Agreement is made between Quincy Productions ("Company") and the Client identified below ("Client"). By making a booking with Quincy Productions, both parties agree to the following terms and conditions.
1. GOOD FAITH & REMEDIES
Good Faith: Quincy Productions ("the Company") enters into this Agreement in good faith and with the intent to provide professional, high-quality deliverables.
Breach & Ramifications: In the event the Client breaches any term of this Agreement, the Company reserves the right to:
(a) Immediately suspend all services and withhold deliverables; (b) Retain any deposits or monthly fees already paid; (c) Recover any outstanding balances plus interest and legal costs.
Dispute Resolution: The parties agree to first attempt to resolve any dispute through good-faith negotiation. If unresolved, the parties submit to the jurisdiction of the courts of New South Wales, and the Company reserves the right to pursue arbitration or litigation to recover losses.
2. SCHEDULING AND LATE POLICY
Late Cancellation: Cancellations made within 3 hours of a scheduled appointment due to Client fault will result in a cancellation fee at Quincy Productions' then-current rate.
No-Shows: On-site no-shows or last-minute reshoots caused by Client unpreparedness (e.g., location not ready, key personnel missing) may incur additional labour charges, travel charges or cancellation fees at the company’s then-current rates. 
Weather-Related Cancelations: Quincy Productions monitors local weather conditions to ensure the safety of our crew and the quality of the content.
  • Mutual Rescheduling: If weather conditions make a shoot impossible or unsafe (as determined by the Company), we will work with the Client in good faith to reschedule the shoot at the earliest available time without penalty. If a return visit is required to reshoot due to weather conditions, the Company reserves the right to charge additional fees.
  • If the Client chooses to proceed with a shoot despite inclement weather, Quincy Productions is not liable for diminished quality due to said weather conditions.
  • Client-Initiated Weather Cancellation: If the Client wishes to cancel or reschedule due to aesthetic weather preferences (e.g., "it’s too cloudy") despite it being safe to shoot, the 3-Hour Cancellation Policy applies.
  • Drone services are subject to weather, CASA regulations, and airspace restrictions. Quincy Productions will determine flight feasibility on the day. 
Weekend & Public Holiday bookings are subject to an additional $150 call-out fee.
3. PAYMENT TERMS & LATE FEES
Payment Terms: Invoices are due within 14 days of issue unless otherwise agreed in writing. 
Late Fees: Any invoice unpaid after 30 days will incur a 5% late fee on the outstanding balance. This fee will recur monthly until the balance is paid in full.
Suspension of Service: Quincy Productions reserves the right to pause all production and delivery of assets if the Client has an outstanding balance. 
4. CONFIDENTIALITY
Both parties agree to keep all non-public information confidential. Both parties agree to keep confidential all pricing, discussions, and commercially sensitive information shared under this agreement.
5. CLIENT RESPONSIBILITIES
The Client is responsible for:
  • Providing clear creative direction and brand guidelines.
  • Securing all necessary permits, location clearances, and "Model Releases" for any third parties appearing in the content.
  • Ensuring the shoot location is "camera-ready" at the scheduled start time.
  • Ensuring the properties are in a safe and accessible condition at the time of booking. The company reserves the right to cancel or postpone a shoot due to safety concerns, poor weather, property unpreparedness or lack of access to the property.
Right to Charge: If Quincy Productions arrives on-site and the property is not "Shoot-Ready," or if required clearances are missing, or the property is inaccessible to the production team, the Company reserves the right, at its sole discretion, to:
(a) Proceed with the shoot "as-is" (with the Company not liable for aesthetic outcomes); or
(b) Deem the appointment a No-Show and charge the Client a cancellation/no-show fee at the Company's then current rates.
The Company’s team will spend a maximum of five minutes for light styling or preparation for shooting. It is the agent/vendor’s responsibility to ensure the property is fully photo-ready before arrival.
6. CREATIVE CONTROL & INTELLECTUAL PROPERTY
Creative Control: Quincy Productions retains final creative control over the artistic style of deliverables. Variations in personal taste or aesthetic preference do not constitute a breach of contract.
Usage License: Upon full payment, Quincy Productions grants the Client a perpetual, non-exclusive license for the delivered media. Quincy Productions retains the right to use all media for promotional/portfolio purposes.
7. LEGAL PROTECTIONS
Non-Solicitation: Client agrees not to hire or solicit any employees or contractors of Quincy Productions for a period of 12 months following the termination of this agreement.
Limitation of Liability: To the extent permitted by the Australian Consumer Law, Quincy Productions' liability is limited to the total fees paid by the Client during the 3 months preceding a claim.
Force Majeure: Neither party shall be liable for delays or failures due to events beyond their reasonable control (e.g., acts of God, fire, flood, equipment malfunctions). In the instance a shoot should be cancelled due to such an event, the company will return funds for undelivered services to the client.
8. DELIVERABLES & REVISION POLICY
Standard Turnaround: Photography including drone photography (24 hours), Video Content and virtual staging (48 hours), Social Media Content (48–72 hours).
Some services may require additional business days. The Company will do its best to advise the Client of any delays in advance. 
Floorplans: Floorplans are priced for standard-sized properties. Properties over 500sqm will incur additional charges. 
One-Revision Limit: Each shoot includes one (1) round of minor revisions (e.g., colour tweaks, text corrections, or swap of a specific shot). Revision requests must be submitted in a single consolidated written request within 7 days of delivery. Subsequent revisions or "change of mind" requests that deviate from the original brief will be billed at Quincy Productions' then-current hourly post-production rate.
Revision requests will be completed within 24 hours of the Company receiving the request (excluding weekends).
All revision requests must be provided in one bulk communication via email. 
Deliverables will be accessible to the Client via our online platform, Tonomo, Pixiset, Dropbox or an alternate delivery platform. 
9. RAW FOOTAGE & PROJECT FILES
Ownership: Quincy Productions provides finished, exported deliverables only (e.g., .JPG, .MP4). A client’s final files will be stored by the Company for 30 days from the date of delivery. The company does not guarantee long-term storage or archiving of any media files beyond this period unless otherwise agreed upon in writing.
Excluded Assets: All raw footage, unedited rushes, and proprietary project files (e.g., Premiere Pro or After Effects projects) remain the exclusive property of Quincy Productions and will not be provided to the Client unless a separate "Raw Assets Buyout" is negotiated and paid for in writing.
10. GST & TAXES
GST: All prices quoted in this Agreement or subsequent invoices are inclusive of Goods and Services Tax (GST) unless otherwise stated.
11. INTELLECTUAL PROPERTY & MORAL RIGHTS
Usage License: Upon receipt of full payment, Quincy Productions grants the Client a perpetual, non-exclusive license to use the final deliverables for their business marketing purposes.
Retention of Moral Rights: Quincy Productions and its creators retain all Moral Rights in the works as provided by the Copyright Act 1968 (Cth), including the right to be attributed as the creator of the work.
Limited Consent: Notwithstanding the above, Quincy Productions grants the Client consent to perform standard edits (cropping, resizing, or adding brand overlays) necessary for commercial and social media distribution, provided such acts do not constitute "derogatory treatment" that harms the reputation of Quincy Productions.
Content may not be resold, sublicensed, or transferred to third parties without prior written permission.
